These Terms of Service ("Terms") govern your use of the Team Tracker app at teamtracker.biz, operated by Wifi Money, Inc. ("we," "us," or "our"). By creating an account or using the app, you agree to these Terms. This app is an independent team tool, separate from the trading-education platform it supports, which has its own terms.
The Team Tracker is a productivity and accountability tool for members of the team. It lets you log daily goals, track prospects and leads, view team performance, and access related tools.
You are responsible for keeping your login credentials secure and for activity under your account. You agree to provide accurate information, to use the app lawfully, and not to share your login or access.
When you add prospects or leads, you are responsible for having a proper basis to store their information and to contact them. You agree to comply with all applicable laws when contacting them, including anti-spam and electronic-messaging laws (such as CAN-SPAM and, for text messages, the TCPA), do-not-contact and consent requirements, and any other rules that apply where you and the recipient are located.
You specifically agree that you will not use the Team Tracker, or any contact information stored in it, to:
You are solely responsible for the content of every message you send and for how you contact your prospects and leads. We provide the tool; we do not send those messages on your behalf and we are not responsible for them.
You agree to indemnify and hold harmless Wifi Money, Inc., its owners, and its affiliates from any claims, complaints, fines, penalties, damages, or costs (including reasonable legal fees) arising out of your misuse of the app, your messages to prospects or leads, or your violation of any law or these Terms. If your conduct causes a complaint, legal claim, or regulatory action, that responsibility is yours, not ours. We may suspend or terminate your account immediately, without notice, if we believe you have engaged in spam, harassment, or unlawful or non-compliant messaging.
Team Tracker is a paid subscription service. When you subscribe:
No refunds. By subscribing you agree that all subscription charges are non-refundable. You confirm this agreement at checkout in two places before you pay: an acknowledgement checkbox on the payment screen and an agreement to these Terms inside the secure payment form. It is also shown on every receipt we send and here in these Terms. If you believe you were billed in error, contact us at team@teamtracker.biz and we will look into it.
You agree not to initiate fraudulent payment disputes or chargebacks. If you believe you were billed in error, contact us first at team@teamtracker.biz and we will work to resolve it. Initiating a chargeback without first contacting us, or filing a fraudulent dispute, may result in suspension or termination of your paid access, and we reserve the right to recover amounts owed and to dispute illegitimate chargebacks with evidence.
When you subscribe, we keep records of your agreement to these Terms and to the no-refund policy, including the date and time, the version of the Terms you accepted, your IP address, and information about your device and browser. If a chargeback is opened on your account, your access is locked automatically while it is resolved, and we submit our records, including your acceptance records, your receipts, and your account activity, as evidence to the card networks.
The Team Tracker is a tool. We make no promise or guarantee of income, recruiting results, or specific outcomes from using it. Any results referenced are not typical. Your results depend on your own effort and many factors outside our control.
You agree not to misuse the app, interfere with its operation, attempt unauthorized access, or use it to send unlawful or unsolicited messages.
The app relies on and references third-party services (for example payment, email, and hosting providers) that we do not control. We are not responsible for the performance, availability, or failures of any third-party service.
The app, its content, branding, and design are owned by us or our licensors and may not be copied, reproduced, resold, or reused without permission.
The app is provided "as is" and "as available," without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not guarantee uninterrupted or error-free operation.
To the fullest extent permitted by law, Wifi Money, Inc., its owners, and its affiliates are not liable for any indirect, incidental, or consequential damages, including loss of profits, data, or opportunities, arising from your use of the app or any downtime or interruption.
We may suspend or terminate accounts that violate these Terms. You may stop using the app and request account deletion at any time by emailing team@teamtracker.biz.
Suspension. A suspension is not a deletion. While an account is suspended you will not be able to sign in, but your account data (including your profile, activity history, and any leads or prospects you have entered) is preserved unchanged. If your account is suspended and you believe this is in error, or you have questions about your account or your data, contact us at team@teamtracker.biz. We decide whether and when to reinstate a suspended account, or to convert a suspension into a termination, at our reasonable discretion. Requests concerning your personal information during a suspension are handled as described in our Privacy Policy.
We may update these Terms from time to time. Continued use after changes means you accept the updated Terms.
Please read this section carefully, as it affects your legal rights. You and Wifi Money, Inc. agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the app will first be addressed through good-faith informal negotiation by contacting us at team@teamtracker.biz. If the dispute is not resolved within sixty (60) days, it will be resolved by binding individual arbitration, rather than in court, except that you may bring claims in small-claims court if they qualify. The arbitration will be administered by a recognized arbitration provider under its applicable rules, and judgment on the award may be entered in any court of competent jurisdiction.
To the fullest extent permitted by law, you and we agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate more than one person's claims or preside over any form of class proceeding. If this class-action waiver is found to be unenforceable, then the entirety of this arbitration section will be null and void. Nothing in this section prevents either party from seeking injunctive or equitable relief in a court of competent jurisdiction for matters related to intellectual property, unauthorized access, or misuse of the app.
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be severed and the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision. These Terms, together with our Privacy Policy and Risk Disclaimer, make up the entire agreement between you and us regarding the app and supersede any prior agreements on that subject.
These Terms are governed by the laws of the United States and the state in which Wifi Money, Inc. is organized, without regard to conflict-of-law rules.
